Mr R Dale applied on behalf of James Toes for a full licence to sell spiritous liquors by retail on the premises at the corner of Bootham row, known as the Bootham Tavern.
Mr Dale urged that the house was very suitable for the purpose required, and it consisted of no less than nine bed rooms, four sitting rooms, and a dram shop.
As to stable accommodation, Mr Toes could find this on adjoining premises, within a few yards of his own. These were however, not his own premises. Mr Toes was highly respected, and there was never the slightest complaint against the conduct of the house.
Mr Toes had occupied the house for the sale of beer during the last thirteen years.
The Lord Mayor pointed out that this case was before the magistrates last year. Mr Dale observed that it had been twice previously before the court. He then presented two memorials in favour of granting the licence, one from gentlemen who had lodged at the house, from London, Liverpool, Sheffield etc. Mr Dale said if the court refused this licence they would be refusing the request of almost the whole of the inhabitants of Bootham. There would not be one person who would object to the licence except the occupier of the Bird in Hand Hotel, and this because it would interfere with his house adjoining. Licence was refused.
